This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of domain name https://pixa24.com/ ("Website"), including the related mobile site and mobile application (hereinafter referred to as "Platform").

The Platform is owned by JACULUS TECHNOLOGIES PRIVATE LIMITED, a company incorporated under the Companies Act, 1956 with its registered office at PLOT NO.28, JAY MALHAR PARK, AHMEDNAGAR, Ahilyanagar, Maharashtra, 414001 (hereinafter referred to as "Platform Owner", "we", "us", "our").

Your use of the Platform and services and tools are governed by the following terms and conditions ("Terms of Use") as applicable to the Platform including the applicable policies which are incorporated herein by way of reference. If You transact on the Platform, You shall be subject to the policies that are applicable to the Platform for such transaction. By mere use of the Platform, You shall be contracting with the Platform Owner and these terms and conditions including the policies constitute Your binding obligations, with Platform Owner. These Terms of Use relate to your use of our website, goods (as applicable) or services (as applicable) (collectively, "Services"). Any terms and conditions proposed by You which are in addition to or which conflict with these Terms of Use are expressly rejected by the Platform Owner and shall be of no force or effect. These Terms of Use can be modified at any time without assigning any reason. It is your responsibility to periodically review these Terms of Use to stay informed of updates.

For the purpose of these Terms of Use, wherever the context so requires "you", "your" or "user" shall mean any natural or legal person who has agreed to become a user on the Platform.

ACCESSING, BROWSING OR OTHERWISE USING THE PLATFORM INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING.

The use of Platform and/or availing of our Services is subject to the following Terms of Use:

1. Acceptance of Terms

These Terms govern your use of Pixa24 (the "Service"). By creating an account or using the Service you agree to be bound by these Terms.

2. Services

Pixa24 provides creative visual design and animation tools, including canvas editing, asset management, export features and related studio workflows. Features depend on your account type and subscription plan.

3. Accounts & Authentication

You are responsible for keeping account credentials secure. We support email/password registration and Google Sign-In. Do not share credentials with unauthorized persons. We may suspend accounts that violate these Terms.

4. Payment, Billing & Subscription

Payments are processed via Cashfree. By purchasing or subscribing you authorize Cashfree and Jaculus Technologies Pvt Ltd to charge your chosen payment method for applicable fees and taxes.

  • Plan changes: Charges may be adjusted when changing plans during a billing period as described at checkout or in your billing settings.
  • No refunds: We do not provide refunds currently unless required by applicable law. By making a payment you acknowledge and accept this no-refund policy.

5. Acceptable Use

You may use the Platform only for lawful purposes. You agree not to create, upload, generate, export, share or distribute any content that is illegal, harmful or prohibited, including without limitation:

  • Nudity, pornography, sexual content involving minors (or anyone who appears to be a minor), or any sexually exploitative material;
  • Content that promotes violence, terrorism, hate, harassment, or discrimination;
  • Content that infringes intellectual property, privacy or other rights of others;
  • Fraudulent, defamatory, deceptive or otherwise unlawful material;
  • Spam, malware or any attempt to disrupt or abuse the Service.

We reserve the right to remove content, suspend or terminate accounts that misuse the Platform or violate these Terms or applicable laws, without liability to you.

Free use without login: You may use parts of the Platform as a guest without creating an account. Guest / free public use may leave little or no lasting account identity on our systems, so we may not be able to identify or contact the person who created specific content. Even so, full responsibility and liability for any content created, exported or shared while using the Platform — whether logged in or not — remains solely with the person who created or used that content. Pixa24 is not liable for guest-created content.

6. Generated Content & Copyright Ownership

This section applies to images, videos, animations, designs and other creative outputs generated or produced using Pixa24 tools on the Platform ("Generated Content"), including content created by guests without login.

  • Guest / free without login: Content created while using the Platform without a signed-in paid account is treated as unpaid Generated Content. Copyright and related rights in that content remain with Pixa24 / Jaculus Technologies Pvt Ltd. You may use it only under a limited personal license as described below. Liability for how that content is used or shared remains with you as the creator/user.
  • Unpaid / free accounts: If you are signed in but are not a paid subscriber at the time the Generated Content is created, all copyright and related rights in that Generated Content remain with Pixa24 / Jaculus Technologies Pvt Ltd. You receive only a limited, personal, non-exclusive, non-transferable license to use such Generated Content within the Service, unless we expressly grant additional rights in writing.
  • Paid accounts: If you are an active paid subscriber at the time the Generated Content is created, copyright ownership in that Generated Content is assigned to the paid account holder identified by the registered account email address, subject to these Terms and full payment of applicable fees. Ownership applies to that Generated Content only while (and to the extent) your paid status is valid for the relevant creation; it does not transfer Platform software, trademarks, templates owned by us, or third-party assets.
  • User-uploaded assets: For materials you upload that you already own, you retain your pre-existing rights. You grant us a limited license to host, process and display those materials solely to operate and improve the Service. You represent that you have the rights needed to upload and use any assets you add to the Platform.
  • License to operate the Service: Regardless of ownership, you grant Pixa24 a worldwide license to host, store, process, display and technically reproduce your content as needed to provide the Service (including backups, sync and export features you request).

7. Intellectual Property of the Platform

All intellectual property of the Platform software, branding, UI, documentation and underlying technology provided by Jaculus Technologies Pvt Ltd remains our property. You are granted a limited license to use the Service per these Terms. Ownership of Generated Content is governed solely by Section 6 above.

8. Termination

We may suspend or terminate accounts for violations. Account closure does not entitle a refund for prepaid or consumed services. If your paid subscription ends, rights in newly created Generated Content thereafter follow the unpaid rules in Section 6, unless a separate written agreement says otherwise.

9. Disclaimers & Limitation of Liability

The Service is provided "as is" to the maximum extent permitted by law. We are not liable for indirect or consequential damages arising from use of the Service.

No liability for user-created content: Pixa24 and Jaculus Technologies Pvt Ltd are not responsible or liable for any content you create, generate, upload, export or share using the Platform — including content created as a guest without login on the free public editor. You alone are responsible for ensuring your content is lawful and complies with these Terms. Where use is anonymous or unregistered, we may be unable to identify the creator; that does not shift liability to Pixa24. We do not endorse user content and are not liable for claims, losses or damages arising from such content, including claims by third parties.

In no event will the Platform Owner be liable for any indirect, consequential, incidental, special or punitive damages, including without limitation damages for loss of profits or revenues, business interruption, loss of business opportunities, loss of data or loss of other economic interests, whether in contract, negligence, tort or otherwise, arising from the use of or inability to use the Services, however caused and whether arising in contract, tort, negligence, warranty or otherwise, exceed the amount paid by You for using the Services giving rise to the cause of action or Rupees One Hundred (Rs. 100) whichever is less.

10. Governing Law

These Terms and any dispute or claim relating to them, or their enforceability, shall be governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. Nothing in these Terms limits any non-waivable consumer protections that may apply to you under the laws of your place of residence.

Subject to the above, disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Maharashtra, India, unless applicable law requires otherwise.

11. Changes to Terms

We may update these Terms. Material changes will be posted on https://pixa24.com/terms with an updated effective date.

12. User Information & Account Responsibility

To access and use the Services, you agree to provide true, accurate and complete information to us during and after registration, and you shall be responsible for all acts done through the use of your registered account on the Platform.

13. Accuracy of Information

Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials offered on this website or through the Services, for any specific purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

14. Use at Your Own Risk

Your use of our Services and the Platform is solely and entirely at your own risk and discretion for which we shall not be liable to you in any manner. You are required to independently assess and ensure that the Services meet your requirements.

15. Proprietary Content

The contents of the Platform and the Services are proprietary to us and are licensed to us. You will not have any authority to claim any intellectual property rights, title, or interest in its contents. The contents includes and is not limited to the design, layout, look and graphics.

16. Unauthorized Use

You acknowledge that unauthorized use of the Platform and/or the Services may lead to action against you as per these Terms of Use and/or applicable laws.

17. Service Charges

You agree to pay us the charges associated with availing the Services.

18. Lawful Use

You agree not to use the Platform and/or Services for any purpose that is unlawful, illegal or forbidden by these Terms, or by applicable local laws that might apply to you.

19. Third Party Links

You agree and acknowledge that website and the Services may contain links to other third party websites. On accessing these links, you will be governed by the terms of use, privacy policy and such other policies of such third party websites. These links are provided for your convenience to provide further information.

20. Binding Contract

You understand that upon initiating a transaction for availing the Services you are entering into a legally binding and enforceable contract with the Platform Owner for the Services.

21. Indemnification

You shall indemnify and hold harmless Platform Owner, its affiliates, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys' fees, made by any third party or penalty imposed due to or arising out of Your breach of this Terms of Use, Privacy Policy and other Policies, or Your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.

22. Force Majeure

Notwithstanding anything contained in these Terms of Use, the parties shall not be liable for any failure to perform an obligation under these Terms if performance is prevented or delayed by a force majeure event.

Refund Policy

Please note that we do not offer refunds once an order has been placed, unless required by applicable law. All sales are final.
